Terms of Service

These terms are the agreement between you and Spindola Software(“we”, “us”) for use of PoolTidy. By creating an account you agree to them. Please also read our Privacy Policy.

What PoolTidy is — and is not

PoolTidy is software for scheduling, recording, and invoicing pool service work. We do not clean pools and we do not employ, supervise, endorse, or vet any pool service company. The agreement to service a pool is strictly between the pool company and the pool owner. We are not a party to it, and we are not responsible for the quality, timing, safety, licensing, or pricing of work performed.

Any dispute about the work itself, the amount billed, or a missed visit is between the pool company and the pool owner.

Accounts

  • You must be 18 or older to create an account.
  • Give accurate information and keep your password to yourself. You are responsible for what happens under your account.
  • If you create an account for a business, you confirm you are authorized to accept these terms for that business.
  • Tell us promptly if you suspect unauthorized access.

Your data, and what pool companies owe their customers

The customer records a pool company enters stay that company's data. We store and protect them; we do not sell them or use them for advertising.

If you are a pool company, you are responsible for having the right to enter the information you upload about your customers — including addresses, gate codes, and photos — and for complying with the privacy and marketing laws that apply to your business. Do not upload information you were not given permission to hold.

Payments between a pool company and a pool owner

Invoices created in PoolTidyare records of what the pool company has billed. The money itself changes hands outside the app — cash, check, or the company's own card processing. We do not process, hold, or transfer payments between a pool owner and a pool company, and we are not responsible for collecting an unpaid bill.

Subscriptions (pool companies)

  • Pool companies pay a flat monthly subscription, priced by how many active customers they have. The current tiers are always shown on the Billing screen before you subscribe.
  • Subscriptions renew automatically each month until cancelled, and are billed through Stripe.
  • Cancel any time from the Billing screen. Cancellation stops the next charge; you keep access until the end of the period you already paid for.
  • Because we bill month to month and you can cancel before any renewal, payments already made are generally non-refundable — but if something went wrong, email us and we will make it right.
  • If your customer count moves you into a different tier, we will tell you on the Billing screen and you choose when to change plans.
  • We will give at least 30 days' notice in the app before any price increase.
  • Some partners hold a code that waives the subscription fee. Codes are issued by us personally, are not transferable, and can be withdrawn if misused.

Pool owners are never charged by PoolTidy. The app is free for them.

Acceptable use

Do not use PoolTidy to:

  • break the law, or infringe someone else's rights;
  • send harassing, deceptive, or unsolicited bulk messages to customers;
  • upload someone else's personal information without the right to do so;
  • attempt to access another company's or another household's data, probe our security, or interfere with the service;
  • resell or white-label the service without our written agreement.

We may suspend or close an account that breaks these rules, and will tell you why unless we are legally prevented from doing so.

Availability

We work to keep PoolTidy running, but it is provided as-is and we do not promise uninterrupted service. We may change or discontinue features. If we ever shut the service down, we will give you reasonable notice and a way to export your data.

Ending the agreement

You can stop using PoolTidy and delete your account at any time from the deletion page or from your account settings. Deletion is described in the Privacy Policy, and for a company owner it can permanently remove all company data.

Disclaimers and limits

To the fullest extent the law allows, PoolTidy is provided without warranties of any kind, and we are not liable for indirect, incidental, or consequential damages, or for lost profits or lost data. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim, or $100 if you paid us nothing. Nothing here limits liability that cannot legally be limited.

Changes to these terms

We may update these terms. If a change materially affects you, we will update the date above and notify you in the app before it takes effect. Continuing to use the service after that means you accept the new terms.

Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Disputes will be heard in the state or federal courts located in Sacramento County, California, and you and we consent to that jurisdiction.
